Our Contract With You
- These are the terms and conditions on which we provide childcare services to you at Early Years Day Nursery Uxbridge.
- Please read these Terms carefully and ensure that all details on your Registration Form and within these Terms are complete and accurate before signing.
- Submitting a Registration Form does not guarantee that a place will be available for your child. A contract between you and the nursery will only come into existence once we confirm in writing that we are able to offer your child a place.
- Once a place is confirmed, these Terms become legally binding between you and the nursery.
- Parents are required to comply with all nursery policies and procedures, which are available upon request and form part of these Terms.
- The nursery reserves the right to amend these Terms and Conditions at any time. Updated versions will be provided in writing and will take effect from the date specified.
Useful Details
- The nursery operates Monday to Friday from 7:30am to 6:30pm and is open for 51 weeks of the year.
- The nursery is closed for one week between Christmas and New Year, on all bank holidays, and for up to three inset days per year for staff training. These inset days usually take place in January, April and August, typically following a bank holiday, although exact dates may vary and will be communicated to parents in advance.
Fees & Registration
- A non-refundable registration fee of £250 is applicable to all wraparound care places. The nursery does not operate a deposit system, and once a place has been accepted and confirmed, parents are committed to the agreed start date and sessions, with the standard notice period applying should you wish to cancel.
- The nursery operates for 51 weeks of the year. Fees are calculated based on the agreed sessions, multiplied across 51 weeks and divided into 12 equal monthly payments. For children attending five full days per week, fees are calculated over 50 weeks.
- Fees are not charged for the Christmas closure period; however, fees remain payable for bank holidays and inset days, as fees are calculated across the full year.
- All fees are payable monthly in advance on the 1st of each month. Payments are accepted via direct debit, Tax-Free Childcare account or bank transfer.
- Fees remain payable during periods of absence, including sickness, holidays or any non-attendance and no refunds or fee reductions will be issued in such circumstances.
- Fees are charged for your child’s place at the nursery rather than actual attendance.
- The nursery reserves the right to close temporarily due to circumstances beyond its control, including but not limited to extreme weather, public health concerns, government restrictions, utilities failure or emergency situations. In such circumstances, fees will remain payable as the nursery place is being held for your child and no refunds or fee reductions will be issued in such circumstances.
- If the monthly payment is not received within 5 days of the due date (or the date agreed with you), a £50 administration fee will be applied. By signing the Registration Form you are agreeing to us recovering any costs incurred in the recovery of late or unpaid fees, including but not limited to legal and court fees. The nursery reserves the right to suspend or terminate your child’s place if fees remain outstanding more than 30 days beyond their due date and registration may be terminated.
- We may review our fees from time to time and may take the decision to increase them. If we do so, we shall give you at least one full calendar month’s written notice of the revised fees and of your revised monthly fee. If you do not want to pay the revised fees and wish to cease using our childcare services, you can bring this contract to end by providing us with one full calendar month’s written notice.
- Please note, a late collection fee of £25.00 will be charged for any period of up to 15 minutes beyond your booked hours. Additional fees will apply for every further 15-minute period.
- Parents must ensure their child is collected on time. In the event of late collection, the nursery will follow safeguarding procedures, including attempting to contact all authorised persons. Continued late collection may result in further action or review of your child’s place.
Funding
- The nursery accepts Government funding for eligible children from the term after a child turns 9 months old, in line with Local Authority guidelines.
- Funding is stretched across 51 weeks of the year, with 15 hours equivalent to approximately 11 hours per week and 30 hours equivalent to approximately 22 hours per week.
- Funding covers core childcare provision only and does not include meals, consumables, additional hours, or enhanced and extra curriculum activities, for which additional charges will apply. Parents have the option to opt out of these charges by providing their own items, subject to nursery policies and requirements, and full details will be provided during your show around.
- Parents must apply for and provide a valid eligibility code, along with all required documentation, for funding to be applied.
- From the term after a child turns 3 years old, where parents are not eligible for Working Parents Funding, the child will be entitled to Universal 15 hours funding, in line with Local Authority guidelines.
Sessions and Attendance
- The nursery operates a minimum attendance policy to support children in settling into the routine and gaining maximum benefit from their time at the nursery. The minimum attendance requirement is three half-day sessions spread across three separate days per week.
Notice, Suspension and Termination
- A minimum of one month’s written notice is required if you wish to withdraw your child from the nursery or to reduce or increase the number of sessions attended. Fees remain payable in full during the notice period.
- We may cancel the contract at any time by providing you with at least one full calendar month’s written notice.
- The nursery reserves the right to terminate the contract with immediate effect, including but not limited to cases of non-payment, breach of contract or safeguarding concerns.
- We may suspend the provision of childcare services in the following circumstances:
- where fees are not paid in accordance with these Terms; or
- where the behaviour of a child is considered unacceptable or likely to endanger the safety, health or wellbeing of staff, other children or any other person at the nursery.
Health, Safety & Safeguarding
- If your child becomes unwell during the day, you will be contacted and may be required to collect them.
- Parents must inform the nursery of any illness and follow all sickness policies.
- The nursery has a duty to follow safeguarding procedures and may contact relevant authorities where concerns arise, without prior notice.
- The nursery will only administer medication with prior written consent from a parent or guardian and in accordance with the nursery’s medication policy. Parents must inform the nursery of any medical conditions, allergies or additional needs.

- The nursery maintains all insurances required by law. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence on the part of the nursery, its employees or agents.
- Parents must ensure that all contact details and emergency contact information are kept up to date at all times. The nursery cannot be held responsible for any issues arising from incorrect or outdated information.

- The nursery processes personal data in accordance with data protection legislation. Information provided by parents will be stored securely and used only for the purposes of delivering childcare services and complying with legal obligations.
- Children may take part in outings and activities outside of the nursery premises as part of their learning and development. These may include local walks or visits within the community. Please inform the nursery in writing if you do not consent to your child participating in such outings.
- The nursery will carry out regular observations and maintain records to support your child’s learning and development in line with the Early Years Foundation Stage framework. From time to time, students on placement may also carry out observations as part of their training. You will be informed of this and asked to provide your consent in writing.
- These Terms are governed by English law and both parties agree to submit to the jurisdiction of the English courts.
- These Terms and Conditions, together with the Registration Form and nursery policies, form the entire agreement between the parties.
